These terms of use, read together with the Privacy Policy located at Policy"), constitutes a legal and binding contract ("Agreement") between you and Nain Travels , a company validly existing under the laws of India ("Nain Travels") providing, inter alia, the terms that govern your access to use (i) Nain Travels's website www.skybluebus.com ("Website"), Nain Travels's online travel, accommodation, and allied reservation services, and (ii) any other service that may be provided by Nain Travels from time to time (collectively referred to as the "Services"). You hereby agree and understand that this Agreement is a binding contract between Nain Travels and any person who accesses, browses, or uses the Services in any manner and accordingly you hereby agree to be bound by the terms contained in this Agreement. If you do not agree to the terms contained in this Agreement, you shall not have the right to use the Services and shall forthwith leave the Website and stop using the Mobile Applications. The terms contained in this Agreement shall be accepted without any modification. The use of the Services would constitute acceptance of the terms of this Agreement. You must be 18 (eighteen) years of age or older to register, or visit or use the Services in any manner. By registering, visiting or using the Services, you hereby represent and warrant to Nain Travels that you are 18 (eighteen) years of age or older, and that you have the right, authority and capacity to use the Services and agree to and abide by this Agreement. If you are using the Services on behalf of another organization or entity ("Organization"), then you are agreeing to be bound by the Agreement on behalf of that Organization and you represent and warrant that you have the authority to bind the Organization to this Agreement. In that case, "you" and "your" refers to you and the concerned Organization. This Agreement is published in compliance of, and is governed by the provisions of Indian law, but not limited to: 1) The Indian Contract Act, 1872 2) The Information Technology Act, 2000; 3) The rules, regulations, guidelines and clarifications framed thereunder, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 ("SPI Rules"); 4) Information Technology (Intermediaries Guidelines) Rules, 2011 (the "IG Rules"). Nain Travels authorizes you to view and access the content available on the Services solely for ordering, receiving, delivering and communicating only as per this Agreement. The contents of the Services, information, text, graphics, images, logos, button icons, software code, interface, design and the collection, arrangement and assembly of content on the Website, Mobile Applications or any of the other Services ("Nain Travels Content"), are the property of Nain Travels and are protected under copyright, trademark and other applicable laws. You shall not modify the Nain Travels Content or reproduce, display, publicly perform, distribute, or otherwise use the Nain Travels Content in any way for any public or commercial purpose or for personal gain. All rights and liabilities of the Nain Travels with respect to any Services to be provided by Nain Travels shall be restricted to the scope of this Agreement. In addition to this Agreement, you shall also ensure that you are in compliance with the terms and conditions of the third parties, whose links are contained/embedded in the Services, with whom you choose to transact with. It is hereby clarified that Nain Travels shall not be held liable for any transaction between you and any such third party. Skybluebus.com`s responsibilities 1) Issuing a valid ticket (a ticket that will be accepted by the bus operator) for its network of bus operators. 2) Providing refund and support in the event of cancellation. 3) Providing customer support and information in case of any delay(s) / inconvenience. Skybluebus.com does not take responsibilities for the following: 1) If buses of the bus operators do not depart from the station or arrive at the station on time. 2) If the employees of the bus operators demonstrate rude behavior or misbehave with the customers. 3) If certain aspects of the buses of the bus operators such as seats are not up to the customer's expectations. 4) If the bus operator cancels the trip for reasons unknown. 5) If the baggage of a customer gets lost / stolen / damaged in the event of travel. 6) If the bus operator changes a customer's seat at the last minute to accommodate a lady / infant / aged passenger. 7) If the customer waits at the wrong boarding point (please call the bus operator to find out the exact boarding point if you are not a regular traveler on that particular bus). 8) If the bus operator changes the boarding point and / or uses a pick-up vehicle at the boarding point to take customers to the bus departure point. 9) The timings of bus arrivals and departures are as per the scheduled departure and arrival timings. However, the bus service provider may change the departure and arrival timings or the pickup locations, or the buses may get delayed due to unavoidable reasons such as traffic jams. 10) On the date of journey, the passengers are requested to call on the service provider contact number mentioned in the ticket and reconfirm their pick up point and timing. 11) At the time of boarding the bus, the passengers may be required to furnish the following: 12) A copy of the ticket (A print out of the ticket or the print out of the ticket e-mail). 13) Photo identity proof of the traveler whose name was provided while making the booking. This includes Driving License, Student ID card, Company ID card, Passport, PAN Card or Voter ID Card. 14) Failing to do so, the passengers may not be allowed to board the bus. Skybluebus.com is a booking service only. It shall not be liable to make good the loss of goods or property of passengers for any of the acts, events, incidents whatsoever beyond the control of the company. The trips are subject to cancellation or postponement due to breakdown of the vehicle or insufficient passengers for the trip. Baggage and luggage will be booked at owner's risk subjected to the acceptance by Skybluebus.com's travel partner. Provision of video, air conditioning and any such other services mentioned by Skybluebus.com's travel partners in the buses is their own responsibility. Any refunds / claims due to non-functioning or un- availability of these services needs to be settled directly with the bus service provider. In the event of cancellation of a bus / service trip, Skybluebus.com will assist the passenger in providing an alternative similar service, subject to availability. In case an alternative is not available, then Skybluebus.com shall be liable to the passenger only to the extent of refunding the sum paid by the passenger for the price of the ticket. Passengers hereby consent to receive communications by SMS or calls from Skybluebus.com with regard to services provided by them. We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
